How to
Steps in order
- 1Prefer arbitration and counsel first - divorce is the most detested permissible act.
- 2If unavoidable: one pronouncement in purity, witnesses, calm documentation.
- 3Observe the iddah: 3 cycles, till delivery if pregnant, 4 months 10 days if widowed.
- 4Arrange written maintenance and custody terms; consult a scholar and a lawyer.
- 5Wives facing harm: seek khula through scholars or courts.
Sunnah talaq, triple talaq and khula
The sunnah procedure is one pronouncement (talaq) in a purity period with no intercourse, then waiting through the iddah without expelling the wife - reconciliation (raja) is open during the first two divorces, and witnesses plus calm documentation protect everyone’s rights. Anger-fuelled, drunk, or coerced pronouncements, and “conditional” talaq oaths (“if you do X you are divorced”) all need a scholar’s case-by-case ruling - never self-declare the outcome.
Three divorces at once (triple talaq in one sitting) is a sinful innovation by consensus of practice, yet the majority of scholars count it as three - ending the marriage with only halala-then-remarriage as return - while a minority (Ibn Taymiyyah, Ibn al-Qayyim) count it as one revocable divorce. Because real families live with the consequence, consult a qualified scholar and a lawyer immediately; do not act on internet fatwas. A wife suffering harm can seek khula - separation for compensation (usually returning the mahr) - through scholars or courts, as Thabit ibn Qays’s wife did before the Prophet ﷺ.
Iddah durations, maintenance and custody pointers
Iddah - the waiting period before remarriage - runs: three menstrual cycles for a divorced menstruating woman; until delivery for any pregnant woman (divorced or widowed); four months and ten days for a widow; three lunar months for a post-menopausal or pre-pubescent divorcee; and none at all if divorced before consummation and seclusion. Its wisdom includes establishing pregnancy and space for reconciliation.
During iddah after a revocable divorce the wife stays in the marital home with full maintenance (nafaqa); after irrevocable or widowed iddah, housing continues per school details while maintenance rules differ - record every agreement in writing. Children’s custody (hadana) prioritises the mother’s care in early years with the father’s financial duty fixed - but custody, maintenance sums and legal divorce registration all need a scholar plus a family lawyer in your country, together.
